Privacy Policy of GearFive, Inc.

THIS SERVICE IS INTENDED AS A COMMUNICATION TOOL BETWEEN EMPLOYERS AND EMPLOYEES FOR PURPOSES OF RECOGNIZING EFFORT AND SUCCESSES IN THE WORKPLACE. AS SUCH, EVERYTHING YOU POST, SHARE, OR OTHERWISE COMMUNICATE TO OR THROUGH THE APPLICATION WILL BE ACCESSIBLE BY YOUR EMPLOYER. YOUR EMPLOYER RETAINS FULL OWNERSHIP OVER ALL INFORMATION POSTED TO THE APPLICATION OR USING THE WEB-BASED SERVICES, AND MAY CHOOSE TO USE SUCH INFORMATION IN MAKING EMPLOYMENT DECISIONS.

This privacy policy applies to all products, services, and websites, including this Application (together, the “Services”) offered by Gear Five, Inc. d/b/a AMPT (the “Company”), but does not apply to any third party websites. Such websites are governed by their own privacy policies. We do not share Your Personal Information with any third-party websites (except at Your request) and are not responsible for and accept no liability for their privacy practices.

 

The terms “We,” “Us,” “Our,” mean Gear Five, Inc. The terms “You,” and “Your” refer to You, as a subscriber and user of Our Services. The term “Personal Information” means information that You provide to Us and which relates to an identified or identifiable person, such as Your name, phone number, email address, and other data that is tied to such information.

 

By using Our Services, You agree to be bound by the terms of this Privacy Policy, together with the Terms of Use and all agreements entered regarding these Services. If You do not agree with these terms, You must immediately cease using the Services.

User-Provided Personal Information – Registration for and use of this Application will require that We collect some Personal Information about You, which may include Your name, contact information (via email and otherwise as necessary), and information about Your employment including supervisors, job titles, and employment statistics. We may gather additional information about You from Your social media profiles, should You choose to register Your Application account with such social media providers.

 

Information about Children - Use of this Application explicitly represents that the user is over 13 years old. To the extent possible, given such representations, We do not collect information about children under the age of 13. To the extent such information is unintentionally gathered, We comply fully with the Children’s Online Privacy Protection Act (COPPA) and its provisions on what operators of online services must do to protect children’s privacy and safety online.

Feedback – If You choose to contact Us to provide feedback, register a complaint, or ask a question, We will record any Personal Information and other content that You provide in Your communication so that We can effectively respond to Your communication.

 

Activity – When You use the Services, We receive and store certain information regarding Your use of the Services. Examples include IP addresses, browser types, domain names, and other statistical data regarding Your use of the Services. We may use this data in a way that does not disclose any of Your Personal Information, including for purposes of developing new product and service offerings.

As noted above, We use the information provided to Us to facilitate the commendation and recognition of employees at Subscribing employers. Therefore, all information, included User-Generated Content can and will be shared with participating employers. Employers may use, at their own discretion, such information to make decisions including but not limited to: promotion, changes in pay, suspension, or termination of employment. By consenting to these Terms, You agree to hold harmless the Company for all employment decisions made by Your employer for reasons associated with these Services.

 

We may also use Your Personal Information to:

  • Carry out Our obligations to provide the Services to You under any terms of service between You and Us;
  • Notify You about changes in Our Services;
  • Ensure that content from Our Services is presented in the most effectively manner for You and for Your device;
  • Allow You to participate in interactive features of the Service, whenever You may choose to do so;
  • Provide You with information about parts of the Service We feel may interest you; and
  • Continue Our efforts to keep Our Services safe and secure.

 

We may use Your non-personally identifying information to: understand better how visitors use the Services; research visitors’ demographics, interests, and behaviors; improve the Services; provide visitors with customized Services and information; and for other similar purposes. This information may be combined with Personal Information for Our own purposes. You have the right to access, correct, and delete inaccuracies in your Personal Information and privacy preferences on the Services at any time by signing into your account and editing your Personal Information in your account profile.
